摘要

工程款拖欠已成为当今国内工程建设承包市场上的普遍现象，这对大多数本已举步维艰的施工企业来说，无疑是雪上加霜。同时，工程款拖欠问题也严重影响了工程承包市场的良性发展，引发了一系列社会问题。借助于法律手段回收工程拖欠款往往是较为有效的途径。本文就付款担保、法定抵押权、代位权等合同法律手段作比较分析，指出它们在工程款回收应用中的利弊和注意事项，为施工企业选择合适的法律手段回收二程款提供参考，从而有效维护债权人的合法权益。
