摘要

随着“私人财产不受侵犯”宪法保护程度的增强以及土地有偿使用制度的进一步明确，我国的城市房屋拆迁制度面临严峻考验。本文分析和研究城市房屋拆迁过程中土地使用权收回的正当性、土地使用权变更程序的合法性以及土地使用权补偿的合理性问题，并提出解决这一连锁问题的有效对策，为进一步规范我国城市建设提供理论借鉴和制度参考。

Abstract

With the strengthening of constitutional protection that legal private property is not to be encroached upon and the land usufructs paid regime are further clear

the regime of urban housing dismantling and moving is facing a vigorous test. This paper analyzes three problems: the justice of the withdrawal of land use right

the legality of the alteration of the land use right and the rationality of the compensation of the land use right during the urban housing dismantling and moving. Finally

this paper tries to find some effective measures to solve the chain problems.
